Restoring your trade mark

If you do not renew your trade mark in the 6 months after the renewal date, you have a further 6 months, to apply to restore your mark.

Fill in form TM13

To restore and renew a registration, fill in form TM13 and send us

  • a statement of the reasons why you failed to renew; and
  • a fee of GBP £300 (GBP £100 for restoration + GBP £200 for renewal) plus GBP £50 for each additional class

What happens next?

If we are satisfied that there are enough good reasons for your failure to renew, we will:

  • restore your mark to the register; and
  • send you a Renewal Certificate confirming that we have renewed your mark for the next 10-year period, from the original renewal date.

If we are not satisfied with your reasons for failure to renew, we will:

  • write and explain why we have not accepted them;
  • refund any renewal fees you have paid, but not the GBP £100 restoration fee; and
  • remove your mark from the register of trade marks.
