Making your application online (e-TM3)

If you send us a form TM3 electronically, as soon as we receive it we will send you, within a few minutes, an e-mail notice of receipt. In that document we will give you a unique 10-digit reference number.

You will also receive separate e-mails over a few days relating to the payment details, a copy of your application in PDF format and a filing receipt containing your application number.

If there are errors on the form

We carry out a detailed check of the form, to ensure that all relevant data has been entered correctly. If there are any minor errors in the application that can be solved in a telephone call we will ring you.

If we cannot resolve a query over the telephone we will send you a letter with details of what needs to be done to put the application right. We will allow two months from the date of that letter for you to reply. If you do not reply within that two months the application will be abandoned, and any fees you have paid will be refunded. If you still want to register the mark you will then have to re-apply.

Please note the following

We will capture the text style as it appears on your form TM3. If your mark is accepted, the same style will appear in the advertisement in our journal and on the registration certificate. We can't make changes to the text style after the mark has been filed.

If your trade mark is a logo and/or word presented in a particular style you will need to attach an electronic file in JEPG or TIFF format at the time that you file the application. If we cannot open the file we will tell you and we will not give your application a filing date. That will only be given when we have a file that we can open.

If the application is in order it will then proceed to the examination team who will be dealing with it.

Examination Report

If you have selected fast track examination, the report will be sent by e-mail (within 10 business days) and a confirmation copy by post. Reports for standard examination applications will be sent in around 20 business days by post only.
