Enterprise Act changes

The statutory instrument allowing disclosure of Part 9 EA02 information for civil proceedings came into force on Monday 1 October. These provisions set out the controls on information which can be disclosed to rights holders and consumers to pursue civil cases.

Guidance on the new procedures is available here External Link (see the related documents on the right). A flowchart should be added to that list in the next few days.

The guidance includes a number of simple examples of how the new provisions will affect information disclosure. We would be interested in any feedback from rights holders or enforcement agencies about their experiences of the new Part 9 regime particularly and if the responses to requests for information from public authorities are consistent. If there are further common, simple requests or teething problems that would benefit from updated guidance, BERR are willing to add these to that guidance.
